Kimberly-Clark 2020 / 2021 Trader Promotion - Competition Rules

  1. Introduction
  • Participation in this Competition is governed by these terms and conditions (the “Rules”).
  • This Trader Incentive Program is limited to Traders only (Traders defined as small business owners (not individual consumers) purchase products for reselling)).
  • Participants are encouraged to review the Rules before entering the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
  • This competition is operated by Kimberly-Clark of South Africa (Pty) Ltd (“Kimberly-Clark”) in conjunction with JupiCorp T/A TMARC (Pty) Ltd (the “Promoters”).
  • The value of the participating products hosted on the till slip submitted must total no less than R1,000 (One Thousand Rand) for the Trader to be eligible to be entered into the airtime draw.
  • Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

By participating in this Competition, Participants agree to the rules set out below.

  1. This Competition is limited to traders operating in the republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
  • Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
  • Traders who are not legal residents and/or legal citizens of the Republic of South Africa.
  • This competition is not open to consumers (End Users).
  • Persons or Traders under the age of 18 years.
  1. The Competition will commence on 23rd November 2020 and will end on 23rd February 2021. No entries received after 23rd February 2021 will be considered.
  1. Mechanics - USSD

To participate in this Competition, Participants (Traders) must adhere / be aware of the following:

  • Buy any participating Kimberly-Clark product (listed below), from any participating Wholesaler and / or Key Distributor nationwide, dial USSD code *120*7426# and follow the prompts to being the entry process. Keep proof of purchase (receipt/till slip) in order to be able to stand a chance to win free airtime.
  • USSD cost – 20 cents/20 seconds
  • Upon completion of the USSD portion of the campaign, participants will be sent an SMS with a link to complete their entry and stand a chance to win free airtime. Traders will be required to upload an image of their till slip / invoice onto KC-trader.co.za to be legible.
  1. Mechanics - KC-trader.co.za
  • Once a participant has completed the USSD portion of the promotion, they will receive an SMS with a link to complete their entry in order to stand a chance to win airtime.
  • Participants will click on the link and follow the prompts.
  • Participants will be requested to upload their till slip which must clearly show the reference number and any of the participating products as follows
    • Baby Soft® Mini’s
    • Kotex® Maxi Pads
    • Huggies® Dry Comfort
  • The value of the participating products hosted on the till slip submitted must total no less than R1,000 (One Thousand Rand) for the Trader to be eligible to be entered into the airtime draw.
  • Only unique till slips will be accepted and duplicate till slips will not be considered.
  • Till slips which are damaged or illegible will not be considered.
  • Till slips will be validated in the order they are submitted. Should a till slip be submitted that appears to be a duplicate the first instance of the till slip will be considered as legitimate and all other instances of that till slip will be regarded as duplicates and will not be considered for any incentive.
  • Upon successful validation of the uploaded till slip and upon the promoters being satisfied that the till slip references the correct participating products and is not considered to be fake or a duplicate the participant will be entered into a randomised draw to stand a chance to win a share of R1,000,000 (One Million Rand) in airtime.
  1. The Prizes:

Traders stand a chance to win a share of R1,000,000 (One Million Rand) in airtime.

  • Airtime Prizes:
  • Airtime will be randomly allocated in R100 denominations, limited to one win per unique mobile number.
  • There will be a total of 10,000 instances of R100 airtime for this promotion. The 10,000 instances will make up the total of R1,000,000 (One Million Rand) airtime available.
  • Airtime winners are drawn on a completely randomised basis.
  • Airtime prizes are not transferable for cash.
  • Should a participant be awarded airtime, the airtime will be sent to the mobile number that was used to enter the promotion i.e. the number entered in the page accessed via KC-trader.co.za.
  • The Promoters take no responsibility for the incorrect mobile number being entered into the promotional mechanic.
  • The airtime will be issued in the format of an SMS with a top up airtime pin.
  • Participants will dial the pin to re-charge their mobile device with the associated airtime.
  1. General - Prizes:
  • The potential prize winner is not an actual winner until his/her submission is validated and the promoters are satisfied. If a potential cash prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  • If the Promoters are unable to issue any of the prizes due to technical difficulty on the part of the recipient after 3 (three) attempts made within 3 (three) working days for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified

 

  1. Purpose of data collected
  • Request for Mobile Number:
    • For the awarding of airtime, should the trader be drawn as a lucky winner
    • Future value based communications with the trader i.e. Phase 2.
  • Question: Are you purchasing for…:
    • An additional step to ensure that the audience is a pure trader audience.
  • Question: How much do you spend per shopping occasion?
    • This question will be re-asked in phase 2 to determine brand loyalty, and as a consequence, if spend has increased or decreased per trader.
  • Question: Where do you usually purchase your goods?
    • Provides insight in terms of the most effective sales channels. When coupled with spend the brand can determine the most effective retail channels.
  • Question: How often do you buy?
  • This will kick off re-engagement notifications (SMS) in phase 2 for the purposes of continually informing traders of special offers, product benefits, promotions and stock availability.
  • Question: Preferred reward.
    • Provides insight into the efficacy of airtime as a value exchange as well as well as what other rewards should be considered for future campaigns.
  1. General
  • The judges’ decision is final, and no correspondence will be entered into.
  • The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
  • The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
  • The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
  • By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
  • By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing [email protected] with a subject line: “Trader Program”. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Kimberly-Clark’s privacy policy.
  • Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
  • Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
  • All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
  • The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
  • The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
  • The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
  • By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
  • Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
  • These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and Kimberly-Clark’s consent to the non-exclusive jurisdiction of the High Court of South Africa.
